ADA COMPLIANCE


The Texas General Land Office (GLO) is committed to complying with all applicable state and federal disability laws, including the Americans with Disabilities Act (ADA) and the ADA Amendments Act of 2008 (ADAAA). As part of this commitment, the GLO ensures access to its facilities, services, programs, and employment opportunities for individuals with disabilities in accordance with Title II of the ADA.

The GLO will provide reasonable accommodations to qualified individuals with disabilities to enable them to perform the essential functions of their current or prospective positions. A qualified individual is someone who has a physical or mental impairment that substantially limits one or more major life activities, has a record of such an impairment, or is regarded as having such an impairment.

The GLO strictly prohibits discrimination or harassment against individuals based on disability and does not tolerate retaliation against anyone for exercising their rights under the ADA, ADAAA, or any other applicable laws.

ADA Grievance Procedure

The GLO is committed to addressing concerns related to accessibility in a constructive and respectful manner. If you experience issues related to access to GLO facilities, services, activities, programs, employment, or benefits, you are encouraged to reach out so the matter can be resolved promptly.

To submit a formal ADA grievance, please contact the ADA Coordinator. Alternative means of filing a grievance, such as verbal or accessible formats, are available upon request. Grievances should be submitted no later than 60 calendar days after the alleged issue occurred.

Receipt and Review of a Grievance

Once a grievance is received, the ADA Coordinator will provide acknowledgment and work with the appropriate division to review the concern within 15 calendar days. In some cases, the ADA Coordinator may reach out to discuss the grievance and potential solutions.

Efforts will be made to resolve the issue within 60 calendar days. If resolution is not possible within this timeframe, the ADA Coordinator will provide a written response, or another accessible format, explaining the GLO’s position and any proposed resolution.

Appeal Process

If the response does not fully address the concern, an appeal may be submitted within 15 calendar days after receiving the response. Appeals should be directed in writing to:

The Chief Clerk or designee will review the appeal and provide a written or accessible response within 30 calendar days of receipt. This decision will serve as the final resolution of the grievance.

AGENCY RULES


In accordance with Texas Government Code Section 2054.126, the Texas General Land Office has provided the following information on rules that govern the agency operations.


ELECTRONIC INFORMATION RESOURCES ACCESSIBILITY POLICY


Purpose

The purpose of this policy is to ensure that persons with disabilities have equitable access to and use of electronic and information resources (EIR) to the same extent as persons without disabilities. This policy guides the GLO’s compliance with accessibility regulations in accordance with the Texas Administrative Code, Title 1, Chapters 206 and 213.

Scope

This policy applies to all GLO employees, contractors, vendors, and service providers who develop, procure, maintain, or use EIR under the GLO’s authority. All individuals subject to this policy are responsible for understanding and complying with its terms and conditions.

This policy encompasses all EIR, whether developed or managed directly by GLO or through third-party contracts, including any EIR used by GLO vendors and service providers when specified in contractual agreements.

Policy

  1. General Commitment: The GLO is committed to ensuring that its electronic and information resources are fully accessible to users of all abilities, in accordance with Chapter 2054, Subchapter M of the Texas Government Code.
  2. Responsibilities: The GLO must ensure that its websites and electronic information resources comply with all accessibility standards. The Information Technology Services Department of the GLO is responsible for overseeing compliance, performing accessibility assessments, and implementing necessary adjustments to meet accessibility standards.
  3. Request for Accommodation: Reasonable efforts will be made to accommodate users who require assistive technologies or alternate methods to access EIR. When a user is unable to access GLO EIR, they may request accommodations by contacting the GLO. Detailed instructions for requesting accommodations, including alternative formats or methods of access, will be prominently provided on the GLO website. All requests for accommodations will be processed promptly, and reasonable accommodations will be provided to meet user needs.
  4. Exceptions from Compliance: The GLO follows the guidelines for accessibility as defined by the Texas Department of Information Resources (DIR). Requests for exceptions to these accessibility requirements will be handled in accordance with TAC 213.17. All documentation related to exception requests, including the rationale for exceptions and necessary approvals, will be maintained by the GLO Information Technology Services Department and reviewed regularly to ensure compliance.
  5. EIR Accessibility Coordinator: The GLO is committed to continuously improving its website and EIR to enhance accessibility for users with disabilities. The GLO’s designated Electronic and Information Resources Accessibility Coordinator serves as the primary contact for any accessibility-related inquiries or concerns. Individuals experiencing difficulties accessing content on the GLO website or other EIR resources are encouraged to contact the Accessibility Coordinator. When submitting an inquiry, users should provide specific details regarding:
    • The nature of the accessibility issue.
    • The preferred format or method for receiving the material.
    • The web address (URL) of the requested material, if applicable.
    • Contact information to facilitate a timely response.

What information do we collect?

Contact Information: The GLO only collects personally identifiable information (e.g., names, physical addresses, phone numbers, or email addresses, etc.) that you choose to provide.

Purchase and Payment Information: For purchases or payments, your name, address, email address, phone number, physical location information, and/or credit card information may be collected and stored only for the purposes of delivering the goods or services you purchased and for processing transactions.

Cookies and Other Technologies: The GLO website uses third-party cookies to monitor and collect specific types of data. Google Analytics and Siteimprove are employed to track session data, including the time spent on a page, whether the visitor is new or returning, the sequence of pages visited, and various device details like type, operating system, and browser. These analytical tools also provide session statistics such as the number of users, page views, bounce rate, pages per session, and session duration. Additionally, such tools capture approximate geolocation data, identifying the city, state, and country of the visitor. Review the Google Analytics Terms of Use at www.google.com/policies/privacy/partners/ to learn more about how Google uses, collects, and processes analytics data. The GLO also utilizes Meta (formerly Facebook) cookies to track data related to our social media campaigns. The website uses Meta cookies to track visits to deliver a series of advertisement products, including real-time bidding from third-party advertisers and to detect how visitors reached this website by recording a last URL address.

How do we use the information we collect?

The GLO uses information only for the purpose for which it was collected or as described in this Privacy Policy.

Use of Personal Information: If you provide your personal information to the GLO, the GLO will only use it for the purposes described herein. The GLO may use your information or share it outside of the GLO if (1) you authorize the agency to do so; (2) it is necessary to allow our service providers or agents to provide products or services to the GLO in connection with your use of the site; (3) it is necessary in order to facilitate official government business, including, without limitation, responding to your inquiries or requests for information or services, constituent communications, service quality, business management and operation, risk assessment, security, fraud and crime prevention, monitoring, research and analysis, website preferences and trends, or dispute resolution; (4) subject to applicable contractual or legal restrictions, disclosure is necessary to other entities, including other governmental agencies, that perform services or official government business for the State of Texas or on behalf of the GLO; or (5) as otherwise required or permitted by law, including compliance with the Texas Public Information Act (Texas Government Code, Chapter 552).

Compliance with the Public Information Act: All information a state agency maintains is presumed to be public, subject to specific exceptions in the Public Information Act (Chapter 552 of the Texas Government Code) or other law. Other than for actual and prospective GLO vendors or their agents and additional limited exceptions under Texas Government Code section 552.137,    email addresses used to communicate with the GLO are confidential and not subject to disclosure.  Protected health information is protected from public disclosure by the Health Insurance Portability and Accountability Act and Texas Health and Safety Code Chapter 181.

What safeguards do we use to protect your information?

The GLO uses a secure socket layer (SSL) connection to enhance the security of any information you choose to submit to the agency on this website. In other areas of the website, we provide only the security necessary to maintain the website and information we provide to you.

For site security purposes and to ensure that this service remains available to all users, the GLO website employs software programs to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage. Raw data logs are used for no other purposes and are scheduled for routine destruction in accordance with our agency’s retention schedule. 

Credit card and bank information is captured only by NICUSA, the state’s authorized, secure credit card processor which is compliant with all Payment Card Industry (PCI) rules and guidelines.

What choices do I have?

You have choices with respect to the collection and use of your personal information.

  • You can choose not to voluntarily share information with the GLO through its website.

  • You can opt out of marketing emails or text messages by following the unsubscribe instructions provided in the marketing emails and text messages.

  • With few exceptions, you are entitled on request to be informed about the information that the GLO has collected about you.

  • Under Section 559.004 of the Texas Government Code, you are entitled to have the GLO correct information it has collected about you that is incorrect and may submit a request for such information through the Public Information page.

  • You can disable cookies as provided herein.

Fees: The Texas General Land Office does not charge a fee to access, use, or reproduce information on its website or to link to information on its website, unless specifically authorized to do so by the Texas Legislature.

Linking to the GLO Website:

  • Advance permission to link to the GLO website is not required.
  • Links should be established through the appropriate base uniform resource locator (URL) and not through an abbreviated form.
  • The origin or ownership of the content of the GLO website must not be misrepresented by an entity or individual that links to the site.
  • A GLO website page may not be captured within the frame of another site without prior permission from the agency.
  • GLO website content may not be presented as an entity’s or individual’s own.
  • Certain information displayed on the GLO’s website may be trademarked, service-marked, or otherwise protected as intellectual property and must be used in accordance with state and federal laws and must reflect the proper ownership of the intellectual property.
  • Links should be full forward links that pass the client browser directly to the targeted website.
  • Links that create a downloading burden on the GLO’s server(s), such as certain graphics or tables, constitute a misuse of state resources. To prevent that, entities or individuals should contact the GLO to request permission to post a copy of the GLO’s graphics or tables within their website.
  • Entities or individuals that link to the GLO’s website should use reasonable efforts to ensure that persons with disabilities may access their websites.
  • Because the GLO may change its subordinate pages at any time without notice, entities and individuals should routinely verify links to GLO’s subordinate pages.
     

Linking from the GLO Website:

The State of Texas and the GLO promote linking to federal, state, and local government websites that provide information and services that benefit the citizens, local governments and state agencies of Texas. Linking to third-party websites that contain information and/or offer services that further the business goals and missions of the GLO and other state agencies may be considered if there is a public purpose for establishing the link.

The GLO reserves the right to deny links if it determines that a website contains misleading or unsubstantiated claims, conflicts with the purpose of the GLO, or fails to conform to the requirements of the GLO’s linking policy. Linking to another entity’s website does not constitute the GLO’s endorsement of the content, viewpoint, accuracy, opinions, policies, products, services, or accessibility of the site. The GLO expressly disclaims any liability and/or responsibility for the content of any third-party website linked to from the GLO website.

A site may not be linked to or from the GLO website if the site:

  1. exhibits hate, bias, discrimination, pornography, libelous or otherwise defamatory content;
  2. advocates or promotes the use of alcohol, tobacco, or currently illegal substances;
  3. belongs to or supports a political affiliation; or
  4. furthers the agenda of a political organization or candidate running for office.
